1.0 Purpose of ResNet
1.1 In conjunction with Residence Life, the Information Services division is offering to all residence hall students a free, high speed Internet connection. Each DePaul University residence hall student who brings a computer to DePaul University can plug into the data jack available in his or her room. The necessity of a high-speed connection to the Internetis the sole decision of each Student, but having direct access to electronic mail and the Internet from the residence hallsincreases the opportunity for learning. Also, a dataconnection in the residence hall room makes communicating by e-mail and utilizing the Internet more convenient than dialing into the Internet through a modem. The Student's phone line remains open when connecting to the Internet through the ResNet System.
2.0 Service Description
2.1 DePaul ResNet shall
provide the following services:
- Ability to transmit data, using the Internet standard
data communications protocol, TCP/IP.
- An Ethernet interface connection to the ResNet
Local Area Network(LAN) using copper pair links rated at speeds of 10 Megabits per second.
- A dynamic Internet Protocol (IP) address.
- Telephone support, during normal operation hours described below.
- No charge for residence hall room changes.
2.2 ResNet sevice expires on the last day of the Summer Term II. ResNet service will be provided over the summer, however students will need to register for the service.
3.0 Sign-Up
3.1 Any Student interested in registering for DePaul ResNet must :
- Agree to the terms and conditions set forth in this Policy.
- Fill out the online application provided on this webpage.
4.0 PC and NIC Compatibility
4.1 Each Student is solely responsible that the computer they want to use for DePaul ResNet purposes is compatible with the residence hall network. A list of network compatible computers is available at the
Hardware Compatibilty List.
4.2 Each Student who has a NIC installed in their PC prior to signing up for DePaul ResNet is solely responsible that the NIC is compatible with the residence hall network. A listing of compatible network cards can be found at the Hardware Compatibilty List. If the Student has a NIC that is incompatible with the residence hall network, the Student will need to purchase a compatible card at the DePaul bookstore or at any computer hardware retailer. These network cards range in price from $39.00 to $120.00.
5.0 Terms and Conditions of Use
5.1 Student acknowledges and recognizes that: (a) that the Internet contains access to pornographic and other material that may be offensive and not suitable for minors; (b) that DePaul ordinarily does not filter, censor, edit, or regulate the flow of data, software, graphic images, or other materials on the Internet to or from any of its account holders; (c) the Internet may from time to time contain hostile programs, viruses, worms, Trojan horses and other files that may affect or destroy the operation of or information on the Student's computer.
5.2 Student agrees that DePaul neither endorses nor is responsible for (and under no circumstances shall be liable for) the contents, accuracy or reliability of information and content accessed from the Internet or the Student's ResNet services account (the Account). DePaul makes all reasonable efforts to protect the confidentiality of e-mail transmitted from or through the Account but will not be liable for missing or
misdirected e-mail. DePaul will in no way be responsible for the loss of files or materials due to deletion, error or malfunction. The student is solely responsible for maintaining backup copies of materials on the Account at all times.
5.3 Student agrees that the Account is not to be used for any unlawful purpose, or to transmit material which violates these terms and conditions, any applicable federal, state, and local laws, rules and regulations. This includes, but is not limited to materials which are subject to another person's copyright, material which is threatening, material which is obscene or defamatory, and material which constitutes a trade secret of another person. The Student further agrees that he/she is solely responsible for the compliance of information accessed from, uploaded to, or transmitted from the Account (including information obtained through any hyperlink) with any applicable law.
5.4 Furthermore, student will comply with all university policies, procedures and regulations, including but not limited to print or electronic editions of DePaul University's Computing and Telecommunications Policies, Guidelines for Web Site Creation, World Wide Web Policy, the Student Handbook, the Residence Life Handbook and those listed herein. These policies are subject to change without prior notice. Students agrees to
periodically monitor any changes to these policies. These policies are maintained at

5.5 Sharing Connections: A network connection supplied by DePaul ResNet is solely for the use of the individual subscriber assigned to that connection. Student agrees to utilize the account for his/her own personal use. Connections may not be shared among multiple users. ResNet subscribers cannot use any mechanisms (either hardware or software) to provide network connectivity to non-subscribers. This includes sharing a computer with a ResNet account with other students. Neither this Policy nor any rights hereunder, in whole or in part, shall be assignable or otherwise transferable by the individual subscriber to any other individual or organization. Any such assignment or transfer shall be null and void. Anyone attempting to use the service without proper authorization or sharing the service with non-subscribers will have their ResNet account terminated. The Student agrees to be fully responsible for any messages he/she transmits or authorizes another to transmit.
5.6 Servers& General Usage: The operation of any commercial or for-profit enterprise or advertising from web pages is prohibited, along with any re-sale of access or services. Illegal activities -- including, but not limited to, software piracy and copyright infringement -- are prohibited. In addition, IP spoofing, packet sniffing, virus distribution, or any activity that disrupts the network will subject the Student to disciplinary action as discussed herein or in DePaul's computer abuse policies and/or will have their Account terminated according to Section 5.7 and/or will be referred to Student Affairs for proper disciplinary action. DePaul retains sole discretion in determining which activities disrupt the network. Also, DePaul further reserves the right to terminate the connection of any program using an unusually high portion of
bandwidth which unreasonably inhibits the use of the network by other ResNet users or administration.
5.7 Termination: Student may terminate the Account at any time by giving written notice to DePaul. DePaul may terminate the Account without cause and without notice at any time. Upon any violation by Student of this Policy which at DePaul's sole discretion is determined to be of a serious nature, DePaul has the right to terminate the Account without notice and/or take any other actions under the policies and rules of DePaul. DePaul reserves the right to modify, reject, delete or block access to the Account, any information on any web page or any information or service provided through a web site, that DePaul, in its sole discretion, believes is unacceptable, inappropriate for publication on the Internet, or in violation of this Policy. Student agrees that DePaul's failure to respond to any violation shall not be deemed acceptance of such a violation and that DePaul may take corrective action at any time. Upon termination, DePaul will be immediately entitled to deactivate the Account and remove or delete any web pages or other files or programs stored on DePaul's computers. In the event of termination, neither the Student nor DePaul will have further obligation or liability under this Policy, except that Sections 5.0, 9.0, 10.0, 11.0 and 12.0 of this Policy shall survive termination of the Account and this Policy.
5.8 DePaul ResNet subscribers shall take full responsibility for messages that they transmit or any other person they authorize to transmit messages through the university's computers and network facilities and shall obey the policies of discussion forums in which they participate. Laws and rules against fraud, harassment, obscenity, and the like apply to electronic communications no less than other media does. Subscribers who violate these rules and laws, or provide access to others who violate them, may be subject to disciplinary action as discussed herein or in DePaul's computer abuse policies and/or will have his/her Account terminated according to Section 5.7 and/or will be referred to Student Affairs for proper disciplinary action.
6.0 ResNet Customer Support
6.1 Students who are having a problem with their network connection or have questions about ResNet can contact 312.362.8765 between the hours of 8 AM and 12 AM, Monday through Friday and 10 AM and 6 PM, Saturday and Sunday.
6.2 DePaul shall not be liable for defects of student's equipment caused by or originating from any of the following: (1) modifications, alterations, repairs or servicing of the student's equipment by anyone, including student himself/herself, other than authorized personnel from DePaul Customer Technology Services; and (2) physical abuse to, misuse of or operation of the Student's equipment in a manner contrary to ResNet policies, DePaul's computer policies, or the manufacturer's instructions pertaining to the Student's equipment or any other applicable policy.
6.3 Unless otherwise provided in this Policy, DePaul's Customer Technology Services Department shall not be responsible for any PC repairs and shall not perform any PC repairs regardless of the claims made against ResNet or the Customer Technology Service staff, unless the claim is that Customer Technology Services acted in a manner which was grossly negligent. In which case, the Student's sole remedy is to authorize Customer Technology Services to make reasonable commercial efforts to repair Student's PC.
6.4 All ResNet assistance is provided via phone support through the Customer Technology Services department. The Residence Life Office is not responsible at any time for any type of end user support or for any ResNet services. Any service problem or issue related to ResNet should be addressed directly to the Customer Technology Services staff.
7.0 ResNet Hardware and Software Maintenance
7.1 Planned maintenance of the network hardware and software shall occur on a periodic basis, such maintenance may make the network unavailable for periods of time. The Customer Technology Services staff will make reasonable efforts to schedule maintenance when network traffic is low. Advance notice of network downtime may be provided as circumstances permit.
8.0 Limitation of Liability
8.1 NO
WARRANTY. EXCEPT AS SET FORTH IN SECTIONS 1.0 AND 2.0 AND THEIR RESPECTIVE SUBSECTIONS, DE PAUL MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO AN IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, OPERATION, CORRECTNESS, AVAILABLE BANDWIDTH, RELIABILITY OR OTHERWISE REGARDING PRESENT OR FUTURE RESNET SERVICES AND PRESENT OR FUTURE SOFTWARE, HARDWARE AND USER DOCUMENTATION ASSOCIATED WITH RESNET SERVICES. NOR DOES IT IN ANY WAY GUARANTEE THE QUALITY, DATA, CONTENT, ARTISTIC WORTH, OR LEGALITY OF THE INFORMATION, CONTENT, DATA, PROGRAMS, SOFTWARE, SHAREWARE, GRAPHIC IMAGES, ANIMATIONS, OR OTHER GOODS AND SERVICES THAT ARE TRANSFERRED, RECEIVED, PURCHASED, OR OTHERWISE MADE AVAILABLE OR OBTAINED BY WAY OF THE ACCOUNT, WHETHER THE SAME BE OBTAINED THROUGH VOLUNTARY USE OR INVOLUNTARY TRANSFER. DEPAUL DOES NOT WARRANT OR REPRESENT THAT THE SERVICES, SOFTWARE, HARDWARE, AND USER DOCUMENTATION WILL MEET THE STUDENT'S REQUIREMENTS OR THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE.
8.2 THE STUDENT ACCEPTS THE SERVICES, COMPUTER SOFTWARE, HARDWARE AND USER DOCUMENTATION AS IS. THE STUDENT ASSUMES ALL RESPONSIBILITY FOR THE SERVICES, SOFTWARE, HARDWARE AND USER DOCUMENTATION PROVIDED FOR THE INSTALLATION OF, USE OF AND RESULTS OBTAINED FROM RESNET SERVICES. STUDENT ASSUMES ALL RISK AS TO THE QUALITY
AND PERFORMANCE OF THE SERVICES, SOFTWARE PROGRAMS, HARDWARE AND THE USER DOCUMENTATION ASSOCIATED WITH RESNET
SERVICES.
8.3 LIMITATIONS OF LIABILITY. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, WILL DEPAUL BE LIABLE FOR ANY CLAIM, WHATSOEVER BY A STUDENT OR ANY OTHER PERSON, INCLUDING WITHOUT LIMITATION, DAMAGES FOR FINANCIAL
LOSS, RESEARCH OR ACADEMIC INTERRUPTION, LOSS OF ACADEMIC INFORMATION, OR LOSS OF DATA OR ANY OTHER DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE COMPUTER PROGRAMS, HARDWARE, OR USER DOCUMENTATION, THE ACCOUNT, OR OUT OF DEPAUL'S PERFORMANCE OR NONPERFORMANCE OF THESE TERMS, WHETHER IN CONTRACT OR TORT, OR OTHER LEGAL THEORY, EVEN IF DEPAUL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.4 IF SECTION 9.2 IS FOUND TO BE UNCONSCIONABLE OR SEVERED FROM THIS POLICY, DE PAUL'S LIABILITY FOR ALL DAMAGES, REGARDLESS OF LEGAL THEORY, SHALL NOT EXCEED THE SUBSCRIPTION FEES PAID TO DE PAUL BY STUDENT FOR RESNET SERVICES GIVING RISE TO THE LIABILITY.
9.0 Indemnity and Hold Harmless
9.1 Student hereby agrees to indemnify, defend and hold harmless DePaul, its officers, employees, and agents, from and against any and all third party claims, including reasonable attorneys' fees, based on or arising, directly or indirectly, from a breach of this Policy, from any transmission from or through the Account, or from the content of any web pages, specifically including but not limited to the following: (a) any claim that any content, information or service infringes any copyright, trademark or patent, or misappropriates any trade secret or other proprietary right of any third party; (b) any claim relating to "flaming," "spamming," or libeling and/or slandering of or by Student; (c) any claim relating to the receipt (even if authorized) of pornography or obscene materials.
9.2 DePaul will promptly notify the Student of any claim which is subject to this Section upon learning of it, permit Student to compromise or defend such claim and give Student all available information, reasonable
assistance and authority to enable Student to do so.
10.0 Miscellaneous Provisions
10.1 Titles to sections are used merely for convenience and shall not be taken as an interpretation of the contents of those sections or as an attempt to enlarge, limit, or define terms covered by the Policy.
10.2 If any section or clause of the Policy is held to be invalid or unenforceable, then the meaning of that section or clause shall be construed so as to render it enforceable to the extent permitted by law; or, if otherwise deemed unenforceable, the unenforceable portion shall be deemed stricken, and the remainder of the Policy shall remain in full force and effect.
10.3 This Policy and any claims arising therefrom, regardless of legal theory, shall be governed by the internal laws of the state of Illinois, without giving effect to choice of law principles. Student and
DePaul irrevocably consent to the exclusive jurisdiction of the courts located in Illinois in connection with any action arising out of or related to this Policy. Student and DePaul waive any objection based on lack of personal jurisdiction, place of residence, improper venue, or forum inconvenience in any such action.
10.4 If the performance of this Policy, or any obligation hereunder, is interfered with, directly or indirectly, by reason of any circumstances beyond the reasonable control of the party affected, including
without limitation, fire, explosion, Acts of God, war, riots, civil commotion, any law, regulation, ordinance, or requirement of any government or legal body, labor unrest including but not limited to strikes and lockouts,
perturbations in telecommunications transmissions, inability to obtain suitable equipment or components, accident, water damages, flood, earthquake or natural catastrophe or acts or omissions of third parties (including but not limited to communication carriers); then the party affected shall be excused from such performance on a day-to-day basis to the extent of such interference; provided that the party affected shall use reasonable efforts to remove such causes of nonperformance.
10.5 If DePaul University fails, at any time, to enforce or pursue any right or remedy available to it under this Policy, that failure shall not be construed to be a waiver of the right or remedy with respect to any other breach or failure by the Student.
11.0 Glossary of Terms
Bandwidth - The amount of information that can be sent through a connection. This is usually measured in bits per second.
Ethernet
- A method of networking common for local area networks. This can handle 10,000,000 bits-per-second and can be used with many types of computers.
FTP
- File Transfer Protocol - An extremely common way to move files between two Internet sites.
IP Address - Internet Protocol Address
- A numeric code that uniquely identifies a particular computer on the internet. Each computer has a unique address which consisits of four numbers (ranging from 0 - 255), seperated by periods.
LAN - Local Area Network
- A network of computers that is limited to the proximate area, the same building or floor of a building.
Modem
- This is a device that is plugged into your computer and the phone line to allow your computer to 'talk' to other computers.
Network
- When 2 or more computers are connected to share the same resources, a computer network is established.
NIC - Network Interface Card
- This is a card that plugs into your computer to allow your computer to adapt to the appropriate network interface standard.
TCP/IP - Transmission Control Protocol/Internet Protocol
- A set of protocols that defines the Internet.
Telnet
- A command and program used to login from one Internet site to another.
